Step: 1 Threshold

You’ll need to collect sales tax in Maine if you have nexus there. There are two ways that sellers can be tied to a state when it comes to nexus: physical or economic.

  • Physical nexus means having enough tangible presence or activity in a state to merit paying sales tax in that state.
  • Economic nexus means passing a states’ economic threshold for total revenue or the number of transactions in that state.

Economic nexus is triggered when a remote seller exceeds $100,000 USD in gross sales. Registration becomes mandatory once the threshold is met and SaaS is treated as taxable prewritten software accessed remotely.

Step: 2 Business Registration

Register with the Maine Revenue Services (MRS) through the Maine Tax Portal. The process requires creating an online taxpayer account, submitting a Sales & Use Tax Registration application, and designating a responsible party for compliance.

Step: 3 TIN/VAT Number

A Maine Sales Tax Account Number is issued by Maine Revenue Services and functions as the seller’s state tax identification number.

Step: 1 Standard Rate

Standard Maine Sales & Use Tax rate is 5.5% for taxable digital products and remotely accessed software (SaaS).

Step: 3 Reverse Charge (B2B)

The U.S. system does not use a VAT-style reverse charge. Instead, if a seller fails to collect tax, the Maine business customer is legally responsible for use tax self-assessment. For registered SaaS sellers meeting nexus, tax must still be charged on B2B sales unless a valid resale or exemption certificate is provided.

Step: 1 Selling B2C

“True SaaS” (software accessed solely remotely where the user does not receive a copy or download any components) is generally not taxable.

Step: 2 Selling B2B

Tax is charged unless the buyer provides a valid Maine resale or exemption certificate. No reverse charge applies; exemption documentation must be retained for audit defense.

Step: 3 Invoice Requirements

Invoices should contain:

  • Supplier legal name and address
  • Maine Sales Tax Account Number
  • invoice date
  • unique sequential invoice number
  • buyer name and address
  • description of SaaS service
  • taxable amount
  • tax rate
  • tax amount charged
  • total amount due
  • exemption certificate reference (if applicable), and currency used.

Assigned by MRS based on volume; typically monthly or quarterly for remote SaaS sellers.

Step: 2 Filing Deadline

Returns are due the 15th day of the month following the reporting period.

Electronic filing through the Maine Tax Portal with ACH debit/credit or approved electronic payment methods.

Step: 4 Record Keeping
